Rogue Air Trampoline Park Contest

OFFICIAL RULES/Terms and Conditions

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

THIS CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT A LEGAL RESIDENT OF ONE OF THE 50 UNITED STATES OR D.C. YOU MUST BE AT LEAST THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE (21 in MS, 19 in NE AND AL, 18 in ALL OTHER STATES) TO ENTER. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW. WINNERS WILL BE REQUIRED TO EXECUTE AN AFFIDAVIT OF ELIGIBILITY / RELEASE OF LIABILITY / PRIZE ACCEPTANCE AGREEMENT.

BY ENTERING THE GIVEAWAY, YOU AGREE TO THESE OFFICIAL RULES, WHICH FORM A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. THIS CONTRACT INCLUDES INDEMNITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES WHICH MAY NOT APPLY TO RESIDENTS OF YOUR STATE.

PROMOTION PERIOD: The Rogue Air Trampoline Park contest begins at or about 10am Pacific Time on January 9, 2019. Each month, a new winner will be chosen. Entries submitted in January will go towards January contest. Entries submitted in February will go towards February contest, etc.and indefinitely.

A computer owned by Rogue Air Park LLC (the “Administrator”) is the official time-keeping device for the contest.

HOW TO ENTER:  To enter online, post pictures or videos with the hashtag #rogueairpark on Instagram, Twitter, or Facebook. The person posting the entry will be deemed the “Entrant”. By entering, Entrant certifies that he/she is no less than the age of 18 (eighteen) or than the age of majority in the Entrant’s state of residence. Normal Internet access and usage charges imposed by Entrants’ online service will apply.

RULES, ENTRY GUIDELINES, CONDITIONS & REQUIREMENTS: There is no limit to the number of times you may enter the contest. Use of any automated system to participate is prohibited and will result in disqualification. The “authorized account holder” is the natural person assigned an email address connected with the profile(s) by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder. Employees of Sponsor (defined below), Administrator, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible.

Any Entry or portion thereof that is judged, in the sole discretion of Administrator, to be obscene, profane, lewd, defamatory, to contain any third party materials, or to otherwise violate or infringe upon (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Automated, script, macro or robotic Entries submitted by individuals or organizations will be disqualified. Behavior rules of Rogue Air must be complied with in photo or video.

Administrator has the sole discretion to determine whether an entry meets the criteria set forth in these Terms and Conditions. Entries deemed to have met such criteria will be considered “Eligible Entries.”

WINNER SELECTION: Administrator will select one (1) grand prize winner from among all Eligible Entries designated with the hashtag #rogueairpark. The winner will be selected on February 1, 2019 and the first of each month subsequently by selection and immediately notified of the prize via social media. Winner has 7 days to contact Rogue Air to collect prize.

Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Administrator will award the applicable prize to an alternate winner from among all remaining Eligible Entries. The prize will be fulfilled no later than 4 weeks after the conclusion of the drawing, although no specific time frame for fulfillment is guaranteed by Administrator.

PRIZES: One (1) grand prize will be awarded during the Promotion Period each month. Limit one prize per household. The prizes are not transferable and cannot be assigned, substituted or redeemed for cash except at the sole discretion of Administrator. Administrator reserves the right to substitute a prize of equal or greater value in the event that a stated prize cannot be awarded for any reason. Any federal, state and local taxes are the sole responsibility of the winners. Neither the Administrator, Sponsor nor their affiliates or subsidiaries will be responsible for any loss, liability or damage arising out of the winner’s acceptance or use of the prize. Winners acknowledge that neither Administrator nor Sponsor has made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty or guarantee. Odds of winning depend on the number of Eligible Entries received.

RELEASE: By participating in the Contest or receiving any prize, Entrant agrees to and does hereby indemnify, release and hold harmless, Administrator, Sponsor, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.

PUBLICITY: Except where prohibited, participation in the Contest constitutes Entrant’s consent to Administrator, Sponsor and their agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

GENERAL CONDITIONS: Administrator reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Administrator’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Administrator in its sole discretion. Administrator reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Contest, provided that, if it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, Administrator, in its sole discretion, may elect to select another entry from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded.

DISPUTES: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Oregon or Oregon state court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased and consent to the exclusive jurisdiction of the courts of Oregon. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Administrator in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Oregon without giving effect to any choice of law or conflict of law rules (whether of the State of Oregon or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.

ENTRANT’S PERSONAL INFORMATION: Sponsor’s use of any information submitted in connection with this Contest is subject to Sponsor’s Privacy Policy contained below. Administrator’s use of information submitted as part of the Contest will be limited to administering and conducting the promotion. Administrator will not use any information submitted for any other purpose.

CONSENT FORM

By entering this contest, I give  permission to Rogue Air Trampoline Park to share photographs and videos entered into this Contest, and to publish those photographs for any lawful purpose, including, but not limited to, their website, social media accounts, and promotional materials, either digital or in print, in perpetuity. I also grant permission to use my name. By entering this Contest, I authorize Rogue Air Trampoline Park to edit, alter, share, remix, tweak, build upon or in any way alter the photograph(s)/video(s) mentioned above. I also waive any rights of privacy or compensation associated with the use of my images for the personal or commercial purposes outlined above.

PRIVACY POLICY

Introduction

Rogue Air Trampoline Park values its visitors’ privacy. This privacy policy is effective 1/9/19; it summarizes what information we might collect from a registered user or other visitor (“you”), and what we will and will not do with it.

Please note that this privacy policy does not govern the collection and use of information by companies that Rogue Air Trampoline Park] does not control, nor by individuals not employed or managed by Rogue Air Trampoline Park. If you visit a Web site that we mention or link to, be sure to review its privacy policy before providing the site with information.

What we do with your personally identifiable information

  • Your photographs or videos entered into this Contest

If you do provide personally identifiable information to us, either directly or through a reseller or other business partner, we will:

  • not sell or rent it to a third party without your permission — although unless you opt out (see below), we may use your contact information to provide you with information we believe you need to know or may find useful, such as (for example) news about our services and products and modifications to the Terms of Service;
  • take commercially reasonable precautions to protect the information from loss, misuse and unauthorized access, disclosure, alteration and destruction;
  • not use or disclose the information except:
    • as necessary to provide services or products you have ordered, such as (for example) by providing it to a carrier to deliver products you have ordered;
    • in other ways described in this privacy policy or to which you have otherwise consented;
    • in the aggregate with other information in such a way so that your identity cannot reasonably be determined (for example, statistical compilations);
    • as required by law, for example, in response to a subpoena or search warrant;
    • to outside auditors who have agreed to keep the information confidential;
    • to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale or disposition of all or a portion of Rogue Air Trampoline Park’s assets. The successor organization’s use and disclosure of your personally-identifiable information will continue to be subject to this privacy policy unless (i) a court orders otherwise, for example a bankruptcy court; or (ii) the successor organization gives you notice that your personally-identifiable information will be subject to the successor organization’s own privacy policy, along with an opportunity for you to opt out (which may cause you not to be able to continue to use the rogueairpark.com.     • as necessary to enforce the Terms of Service;
    • as necessary to protect the rights, safety, or property of Rogue Air Trampoline Park, its users, or others; this may include (for example) exchanging information with other organizations for fraud protection and/or risk reduction.

Changes to this privacy policy

We reserve the right to change this privacy policy as we deem necessary or appropriate because of legal compliance requirements or changes in our business practices. If you have provided us with an email address, we will endeavor to notify you, by email to that address, of any material change to how we will use personally identifiable information.
